WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF THE RISK, AND INDEMNITY FORM

DISCLAIMER: YULIA MAUI ART, LLC (“YULIA”), ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS, ARE NOT RESPONSIBLE FOR ANY INJURY, DAMAGE TO OR LOSS OF PROPERTY TO ANY PERSON WHILE PARTICIPATING IN YULIA’S ART CLASSES AND WORKSHOPS CAUSED BY THE ACTS OF YULIA OR OTHER PERSONS’ WHILE ON YULIA’S PREMISES.

I am fully aware and understand that injury, illness, damage or loss of property may result from the actions, inactions of Yulia or other persons participating in Yulia’s art classes and workshops.

I am also fully aware and understand that in Yulia’s art classes and workshops, epoxy resin and fluid acrylic, paint, as well as other compounds and chemicals will be used. I acknowledge that I am not allergic to epoxy resin, fluid acrylic, paint other compounds and chemicals. If I feel any adverse reaction to the epoxy resin, fluid acrylic, paint or other compounds and chemicals, I will immediately notify Yulia. I agree to follow all safety rules instructed by Yulia including the use of the Butane torch and heat gun. I have the option of using the personal protective equipment provided by Yulia but I assume all risks if I decide not to do so.

In consideration for participating in Yulia’s art classes and workshops, I, on behalf of myself, my heirs, personal representatives, agents and assigns, hereby release, waive, discharge, and hold harmless Yulia from any and all claims, liabilities, damages, or causes of action arising out of or in connection with my participation in Yulia’s art classes and workshops, including any personal injury, illness, property damage or loss caused by Yulia’s negligent acts or omissions while on Yulia’s premises.

I agree to defend, indemnify and hold harmless Yulia, its members, directors, officers, employees, representatives, and agents, for any and all personal injury or property damage claims arising from my negligent, willful or intentional act while participating in Yulia’s art classes and workshops or while I am on Yulia’s premises, wherever, whenever and however the claims may arise.

I voluntarily assume any and all risks of participating in Yulia’s art classes and workshops and accept full liability for any damages, expenses, loss of property, personal injury to Yulia or other persons participating in Yulia’s art classes and workshops, resulting from my negligence, willful or intentional act.

I consent and authorize Yulia to take photographs of my artwork and crafts to post on Yulia’s website or to display in Yulia’s gallery for promotional purposes. Please initial if you do not consent. _______

If I consume alcohol, I agree not to drink excessively. I also agree that I, and not Yulia will be solely liable for any personal injury, property damage or loss caused by my consumption of alcohol. I further agree that Yulia can stop my consumption of alcohol and recommend that I not drive a motor vehicle.

I further understand and agree that this WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF THE RISK AND INDEMNITY FORM will apply to each time that I participate in Yulia’s art classes and workshops and that I do not have to sign a new form each time that I participate in Yulia’s art classes and workshops.

I HAVE READ AND FULLY UNDERSTAND THE ABOVE. BY SIGNING THIS WAIVER, RELEASE, ASSUMPTION OF RISK AND INDEMNITY FORM, I ACKNOWLEDGE THAT I AM SIGNING IT FREELY AND VOLUNTARILY.
